CALIFORNIA APPELLATE COURT AFFIRMS BREACH OF CONTRACT RULING IN FAVOR OF BELLA ALL NATURAL, INC.
On December 7, 2023, the Second District Court of Appeal affirmed the trial court’s ruling in favor of Thakur Law Firm, APC’s client Bella All Natural, Inc., owned by renowned entrepreneur Daisy Cabral. The case was centered on a dispute between Bella All Natural and Latina celebrity Mayeli Alonso, specifically on Ms. Alonso’s failure to market Bella All Natural’s products as she promised under the contract. The trial court held that because Ms. Alonso failed to perform as promised, she was liable to Bella All Natural for $220,333.00.
The Court of Appeal rejected Ms. Alonso’s argument that Bella All Natural was not entitled to damages merely because the company’s profits increased during the period of the contract. Instead, the Court agreed with Managing Partner Pamela Thakur’s argument that, because Bella All Natural paid Ms. Alonso $220,333.00 for services that were never performed, Bella All Natural is entitled to such amount in damages, along with interests and costs on appeal.
This affirmation on appeal marks the end of a highly publicized, high-stakes, and fraught dispute with a celebrity with a substantial following in the Latino community.
